Throughout the website, the terms “we”, “us” and “our” refer to KIMKO Pet Company.

By visiting our sire and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions. Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Our store is hosted on Squarespace. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

ONLINE STORE

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the service, violate any laws in your jurisdiction. You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.


INACCURACIES

The information on the website may contain typographical errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change and update information at any time without prior notice. Please note that such errors, inaccuracies or omissions may relate to product description, pricing and availability.


Colours

We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, monitor discrepancies and your settings may affect the display of colour and therefore we cannot guarantee that the colour you see on the website will be accurate.


Returns & Exchange

We accept returns and exchanges in accordance with the Australian Consumer Law. Returns and exchanges are provided for faulty products only. We do not accept returns or exchanges for change of mind purchases.

If you believe you have received a faulty product, you must contact KIMKO Pet Company with proof of purchase and photographic evidence of the fault. The product must be returned to KIMKO Pet Company in the condition it was received (new, unused and undamaged) and we reserve the right to assess the item before providing a refund or exchange. Your return or exchange will be processed within 7 days of us receiving the item and/or receiving photographic evidence and agreeing to its fault.


Shipping

We use the most suitable shipping partner(s) to fulfill your order. Your order may be shipped through Australia Post, Sendle, DHL or any other relevant shipping and/or postal company that services your shipping address. Orders that have been ‘returned to sender’ by these shipping and postal partners are at the expense of the customer. Redeliveries are at the expense of the customer. Any RTS fees that were charged to us by the shipping or postal partner due to customer failure to collect, incorrect address provided or any other reason, will be onforwarded to the customer.

We are not obligated to refund your order if delivery was unsuccessful, but any negotiated refunds will be minus any return to sender fees, original shipping feeds and a 10% administration fee.

If your parcel has arrived damaged, please take photos immediately and send them to kimkopetcompany@gmail.com/

If your parcel has not arrived after the estimated arrival date, you may launch an investigation with the courier or contact us to initiate.

If your parcel has been marked as successfully delivered, but you believe it is missing, raise this direct with the shipping or postal partner as they will have information on location of the parcel.

KIMKO Pet Company holds no responsibility for how long it may take a parcel to arrive.


Limitation of Liability

KIMKO Pet Company does not warrant that the function or operation of this website will be uninterrupted or error-free, that defects will be corrected, or that this site or the server that makes it available will be free of viruses or other harmful elements. As a visitor to, and user of, this website, you must assume full responsibility for any costs associated with the servicing of equipment used in connection with the use of our website. As a visitor to, and a user of this website, you, in effect, agree that your access will be subject to the terms and conditions set forth in this legal notice and that access is undertaken at your own risk. KIMKO Pet Company shall not be liable for damages of any kind related to your use of or inability to access this website.
